2. Use of Our Services

By using our services, you represent that you are at least 18 years of age and capable of forming a binding contract. You agree to:

• Provide accurate, current, and complete information when using our services.
• Maintain the security of your account credentials.

3. Property Management Services

Upfront Properties Ltd provides comprehensive residential property management services including:

• Tenant Management (onboarding, screening, engagement, retention)
• Lease Administration (preparation, enforcement, renewal)
• Maintenance Oversight (inspections, repairs, 24/7 resolution)
• Financial Management (rent collection, budgeting, reporting)
• Marketing & Occupancy (advertising, high occupancy rates)
• Vendor & Staff Coordination
• Renovations & Improvements

Specific terms for each service will be outlined in separate service agreements or property management contracts.

4. Fees and Payments

Our property management fees are transparent and will be clearly communicated in your service agreement. Payment terms include:

• Management fees are typically calculated as a percentage of monthly rent collected.
• Additional fees may apply for maintenance coordination, tenant placement, or eviction services.
• All fees are due as specified in your service agreement.
• Late payments may incur additional charges as outlined in your agreement.

5. Client Responsibilities

As a client of Upfront Properties Ltd, you agree to:

• Maintain your property in good condition and comply with all applicable laws and regulations.
• Provide accurate information about your property and authorize necessary repairs or maintenance.
• Respond promptly to communications regarding your property.
• Maintain appropriate insurance coverage for your property.

6. Limitation of Liability

To the maximum extent permitted by law, Upfront Properties Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services.
• Any conduct or content of any third party on our services.
• Unauthorized access, use, or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the services will cease immediately.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Nairobi, Kenya.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
